Terms of Service

By creating an account or using any Serversify service, you agree to be bound by these Terms of Service ("Terms"). If you are entering into this agreement on behalf of an organisation, you represent that you have authority to bind that organisation.

These Terms apply to all Serversify services including VPS Servers, Cloud Servers, Dedicated Servers, and any associated APIs, control panel, and support services.

If you do not agree to these Terms, you may not use our services.

You must provide accurate and complete information when creating your account. You are responsible for maintaining the security of your account credentials, including API keys and SSH access tokens.

Sharing account access with third parties is permitted for team members of your organisation but may not be resold or transferred to unaffiliated parties without our written consent.

You must be at least 18 years of age (or the age of majority in your jurisdiction) to create an account. Accounts opened by minors are subject to termination without refund.

You are solely responsible for all activity that occurs under your account, including actions taken by users you have authorised.

Serversify provides infrastructure services as described on our website. We reserve the right to modify, suspend, or discontinue any service or feature with reasonable notice, except in the case of security emergencies.

Service availability is subject to our SLA, currently published at serversify.com/status. SLA credits are the sole remedy for downtime below the agreed threshold and must be claimed within 30 days of the incident.

We do not guarantee any specific throughput, latency, or performance beyond what is specified in your plan documentation.

VPS and Dedicated: Services are billed monthly in advance on the anniversary of provisioning. Annual pre-payment discounts are applied automatically where advertised.

Cloud Servers: Billed hourly based on resource consumption. A minimum charge of one hour applies per server lifecycle. Billing ceases when a server is destroyed (not powered off).

Payment methods: We accept major credit cards and bank transfers (for invoices over £500). All prices are exclusive of VAT and applicable taxes.

Late payment: Accounts more than 5 days past due may be suspended. Accounts more than 30 days past due may be terminated with data deletion. We will attempt to contact you before taking either action.

Refunds: We offer pro-rated refunds for VPS and Dedicated services cancelled within the first 7 days of a new billing cycle. Cloud Servers are non-refundable due to their hourly nature.

Use of Serversify services is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference.

In summary, you may not use our infrastructure for activities including but not limited to: sending unsolicited email, hosting illegal content, launching denial-of-service attacks, cryptocurrency mining above plan resource limits, or reselling services without authorisation.

We reserve the right to immediately terminate services and accounts found in violation of the AUP, without refund.

All content, trademarks, software, and platform elements provided by Serversify are the property of Serversify LLC and may not be reproduced, distributed, or used without our written permission.

You retain all ownership rights to data you store on Serversify infrastructure. You grant us a limited licence to host, copy, and transmit that data solely for the purpose of delivering the services.

You represent that you own or have the rights to all data you upload and that such data does not infringe any third-party intellectual property rights.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SERVERSIFY'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SERVERSIFY IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) £100.

IN NO EVENT WILL SERVERSIFY BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, LOSS OF DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow these limitations — in such cases, our liability is limited to the minimum extent permitted by applicable law.

You may terminate your account at any time through the control panel. Upon termination, all servers and associated data are permanently deleted within 24 hours.

We may terminate or suspend your account immediately if you breach these Terms, fail to pay invoices, or if we receive a court order requiring us to do so.

Upon termination, all outstanding invoices become immediately due. Provisions regarding intellectual property, limitation of liability, and governing law survive termination.

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms shall be resolved exclusively in the courts of England and Wales, to which both parties irrevocably submit.

Notwithstanding the foregoing, either party may seek interim or injunctive relief from any court of competent jurisdiction to prevent irreparable harm.

We may update these Terms at any time. Material changes will be communicated by email at least 30 days before taking effect. Continued use of our services after the effective date constitutes acceptance. If you do not agree to revised Terms, you must stop using our services and close your account.
